Terms & Conditions, Liability Waiver and Participation Agreement

By attending, participating in, or engaging with any event, activity, run, social gathering, training session, wellness event, or related activity organised, hosted, promoted, or operated by The Espy Run Club (“The Espy Run Club”, “we”, “our”, or “us”), you acknowledge that you have read, understood, and agreed to the following Terms & Conditions and Liability Waiver.

If you do not agree to these Terms & Conditions, you must not participate in any The Espy Run Club activity.

Participation at Your Own Risk

Participation in any The Espy Run Club activity is entirely voluntary and undertaken at your own risk.

You acknowledge and agree that running, walking, exercise, fitness activities, social gatherings, wellness activities, and outdoor events involve inherent risks, including but not limited to:

• Slips, trips, falls, or collisions
• Physical injury or illness
• Muscle strains, sprains, fractures, or other bodily injuries
• Cardiac events or medical complications
• Accidents involving roads, pathways, vehicles, bicycles, scooters, animals, or pedestrians
• Weather-related risks including heat, rain, wind, storms, or slippery surfaces
• Hazards associated with public spaces, beaches, footpaths, parks, roads, or shared-use paths
• Negligence or actions of other participants or third parties

You accept full personal responsibility for your participation and all associated risks, whether known or unknown, foreseeable or unforeseeable.

Medical Responsibility

By participating, you confirm that:

• You are physically and medically fit to participate
• You have not been advised otherwise by a qualified medical professional
• You are solely responsible for monitoring your own physical condition during participation
• You will immediately cease participation if you experience pain, dizziness, discomfort, illness, or injury

The Espy Run Club does not provide medical advice, diagnosis, treatment, supervision, or emergency medical services.

You acknowledge that The Espy Run Club is not responsible for any medical costs, injuries, conditions, complications, or health outcomes arising from participation.

Release and Waiver of Liability

To the maximum extent permitted by law, you fully release, waive, discharge, and hold harmless The Espy Run Club, its owners, directors, employees, contractors, volunteers, ambassadors, event organisers, sponsors, affiliates, partners, and representatives from any and all liability, claims, demands, damages, actions, losses, costs, or expenses arising from or related to:

• Personal injury
• Illness or death
• Property damage or loss
• Theft or loss of personal belongings
• Negligence
• Accidents or incidents during participation
• Travel to or from The Espy events
• Actions or conduct of other participants or third parties
• Cancellation, postponement, or modification of events

This waiver applies regardless of the cause of action and includes claims arising in contract, tort, negligence, equity, statute, or otherwise.

Personal Belongings

Participants are solely responsible for all personal belongings brought to any The Espy Run Club event or activity.

The Espy Run Club accepts no responsibility or liability for any lost, stolen, damaged, or misplaced items, including but not limited to:

• Phones
• Wallets
• Keys
• Bags
• Watches
• Jewellery
• Clothing
• Vehicles or bicycles
• Other personal possessions

All belongings are brought and left at your own risk.

Public Environment Acknowledgement

You acknowledge that The Espy Run Club activities may occur in public and uncontrolled environments, including roads, footpaths, beaches, parks, shared pathways, and coastal areas.

The Espy Run Club does not control traffic conditions, weather conditions, public hazards, pedestrians, cyclists, animals, or third-party conduct.

Participants are solely responsible for:

• Their own safety and awareness
• Following road and pedestrian laws
• Exercising caution at all times
• Assessing environmental conditions before and during participation

Code of Conduct

All participants are expected to behave respectfully and responsibly.

The Espy Run Club reserves the right to refuse participation or remove any person from an event or activity for:

• Unsafe behaviour
• Aggressive or inappropriate conduct
• Harassment or discrimination
• Intoxication or substance misuse
• Conduct that negatively impacts the safety, wellbeing, or experience of others

Photography and Media Release

By attending The Espy Run Club events or activities, you consent to being photographed, filmed, or recorded.

You grant The Espy Run Club permission to use any photographs, videos, recordings, or media containing your image, likeness, voice, or participation for promotional, marketing, advertising, social media, website, editorial, and commercial purposes without compensation or further approval.

If you do not wish to appear in media content, you must notify The Espy Run Club in writing prior to participation.

Minors

Participants under 18 years of age must have permission from a parent or legal guardian to participate.

Parents and guardians accept full responsibility for the minor’s participation and agree to these Terms & Conditions on their behalf.

No Guarantees or Warranties

The Espy Run Club makes no guarantees, warranties, or representations regarding:

• Safety of activities or locations
• Fitness outcomes or health improvements
• Event schedules or availability
• Weather conditions
• Attendance levels or participant experiences

All activities and services are provided on an “as is” basis.

Indemnity

You agree to indemnify and hold harmless The Espy Run Club and its representatives from any claims, liabilities, damages, losses, legal costs, or expenses arising from:

• Your participation
• Your conduct
• Your breach of these Terms & Conditions
• Any claim brought by a third party relating to your actions

Governing Law

These Terms & Conditions are governed by the laws of South Australia and Australia.

Any disputes arising in connection with The Espy Run Club activities or these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of South Australia.

Acknowledgement and Acceptance

By attending, participating in, registering for, or engaging with any The Espy Run Club activity, event, website, social media platform, mailing list, or related service, you acknowledge and agree that:

• You have read and understood these Terms & Conditions
• You voluntarily accept all associated risks
• You participate entirely at your own risk
• You release The Espy Run Club from liability to the maximum extent permitted by law
• You are responsible for your own health, safety, belongings, and conduct

Your attendance and participation constitutes full acceptance of these Terms & Conditions.
